These Terms of Use ("Terms") are an agreement between you and Global Outsource Solutions Pty Ltd ("PDF Fit", "we", "us", "our") and govern your use of the PDF Fit mobile application and website (together, the "Service"). By downloading, accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.
Our Privacy Policy explains how we handle your personal information and forms part of these Terms.
1. The Service
PDF Fit lets you turn workout plans into trackable training programs. That includes importing a PDF workout plan, having an AI-generated training program built from your answers to an in-app interview (the "AI Program Builder"), getting programs that fitness creators share through PDF Fit, creating programs manually, and tracking your workouts, tests and progress.
2. Eligibility
You must be at least 16 years old to use the Service. By using the Service, you confirm that you meet this requirement.
3. Accounts and guest mode
- You can use parts of the Service as a guest; guest data is stored only on your device.
- When you create an account, you must provide accurate information and keep your credentials secure. You are responsible for activity under your account.
- You can delete your account at any time. See our account deletion page.
4. Purchases, credits and subscriptions
- Payment is handled by your app store. All purchases are made through the Apple App Store or Google Play. We never receive or store your card details. Prices are shown in the store before you confirm any purchase.
- Credits: some features are paid for with one-off credits. For example, PDF import credits, and program credits that unlock the remaining weeks of a program built by the AI Program Builder. Credits are consumed when the corresponding feature completes, do not expire, are personal to your account and are not transferable or redeemable for cash. Free credits we give you, for example when you sign up, have no cash value and are not refundable.
- Subscriptions: PDF Fit Pro is an auto-renewing subscription. It renews automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel it at any time in your app store account settings. Deleting the app or your account does not cancel a subscription.
- Refunds are handled by the app store you purchased through, under that store's refund policies. If a store refunds a purchase, the corresponding credits or entitlements are removed from your account.
- A failed generation costs you nothing: if the AI Program Builder fails to deliver, the credit is not consumed.
5. AI-generated, imported and creator programs
- Programs produced by the AI Program Builder and programs parsed from PDFs are generated by artificial intelligence. They are general fitness information, not medical advice, and may contain errors or be unsuitable for your circumstances despite the information you provide.
- Review any program before training it, and use your own judgment about loads, exercises and intensity. You can report a generated program from within the app, and we review reports.
- The AI Program Builder declines some requests by design, including for users under 16, during pregnancy or postpartum recovery, and where answers suggest a medical condition that needs professional clearance. These refusals are safety features, not defects.
- You own your training data. You are responsible for having the right to upload any PDF you import, and you grant us the limited licence needed to process it into your program.
- Programs shared by creators are written and owned by those creators, not by PDF Fit. We check each program before it goes live, but the creator is responsible for its content. You may use a creator's program for your own training only, not copy, share or sell it. You can report a program or hide a creator from within the app. We may pause or remove a program, including for people who already have it, if it breaks the law, someone else's rights or these Terms.
6. Health and safety warning
Exercise carries inherent risks, including the risk of serious injury. The Service does not provide medical advice, diagnosis or treatment, and no content in the Service, including AI-generated programs, is a substitute for advice from a qualified health professional. Consult a doctor before starting any exercise program, especially if you have (or suspect) any medical condition, injury, or are pregnant or postpartum. Stop exercising and seek medical attention if you feel pain, dizziness or discomfort. To the extent permitted by law, you exercise at your own risk.
7. Acceptable use
You agree not to:
- use the Service for any unlawful purpose, or upload content you have no right to use;
- attempt to probe, disrupt or gain unauthorised access to the Service or other users' data;
- reverse engineer the Service except where the law permits it;
- abuse the AI Program Builder, including attempting to make it produce content unrelated to fitness programming, or circumvent usage limits;
- resell or commercially exploit the Service without our written agreement.
8. Intellectual property
The Service, including its software, design and branding, is owned by us or our licensors. These Terms give you a personal, non-exclusive, non-transferable licence to use the app for your own training. Programs generated for you are yours to use for personal, non-commercial purposes.
9. Disclaimers and limitation of liability
To the maximum extent permitted by law, the Service is provided "as is" and "as available", and we exclude all implied warranties. We do not guarantee that the Service will be uninterrupted, error-free, or that any program will achieve a particular result.
To the maximum extent permitted by law, our total liability for any claims relating to the Service is limited to the amount you paid us in the 12 months before the claim arose, and we are not liable for indirect or consequential loss.
Australian Consumer Law: nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where liability can be limited, it is limited to re-supplying the service or paying the cost of re-supply.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access to the Service if you materially breach these Terms, if we are required to by law, or if we discontinue the Service. Where we terminate without cause, provisions of the Australian Consumer Law about remedies continue to apply to purchases you have made.
11. Changes
We may update the Service and these Terms over time. For material changes to these Terms we will give you notice in the app or by email before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of its courts. If you are a consumer in another jurisdiction, this does not deprive you of protections that mandatorily apply under your local law.
